Rear hatch keeps opening with fuse 9 in?

Going around sorting the little things and stuck a fuse in fuse 9 on the aux board and the sunroof and rear work but the rear hatch keeps going and doesn't stop.
Checked with my meter and I have 12v+ on two of the wires and ground on the other one which doesn't seem right presume one should be dead and only becomes live when switch is pressed?
Now here's the confusing part one manual says fuse 9 isn't used but pull it out and rear hatch and sunroof doesn't work?
 
the rear hatch motor is powered by the switch in the drivers footwell.

once triggered the motor should do one complete turn and be disconected by a break in the copper strip within the motor itself when it gets to the 'park' position like the windscreen wipers

Either the footwell switch is staying pressed in ( maybe a short ) and not disconnecting the hatch motor supply or ...

the hatch motor is not disconnecting the power supply when it reaches the break in the copper strip ie one full revolution. Its difficult to describe in words.[:(]

I believe there are 2x 12v+ supplies to the motor and each has it own circular copper conducting strip and brush like a vloume control.

One 12v+ should be constant and go to the second copper strip in the motor. The other 12v+ is supplied when you press and hold the footwell pushbutton down

When the push button is pressed the first 12v+ supply starts the motor then the copper strip ends but before it ends the other copper strip starts with the second 12v+ supply which drives the motor one revolution to the park position where a break in the copper strip cuts the 12v+ supply to the motor. If the press button is not held down or pushed again the motor should stay there in park. Simples .....

Pull the rear valence carpet back and take a look at the motor and 2x hatch pin actuating arms and pivots to see how it works.
 
All sorted will take a pic of the shorted wire but found two areas of concern one the interior light never worked found some wires touching there but the other one was in the passenger footwell which was found by following the smoking and smell, wires there had shorted an melted together.
All wrapped up banger rally style and the sunroof and rear boot now work lovely jubley, only have one 12v feed coming in and yes the haynes manual is dubious to say the least, have a load of drawings on the mac that I normally work through though which are a lot better.
Had a run to London today and the only issue was a battery neg terminal came loose which caused a bit of spluttering and stereo jumping my fault for not checking after reconnecting. Fitted the new momo steering wheel today and the lower rear valance which both pretty easy tbh, have a water leak from the screen wash somewhere that's today's job and then were off to Italy Thursday morning.
